Culturally Responsive Teaching (CRT) weaves together rigor and relevance while it improves student achievement and engagement. The Philippine Department of Education implemented Indigenous People’s education to respond to the demands for culturally responsive teaching. Teacher education graduates are expected to articulate the rootedness of education in sociocultural contexts in creating a learning environment that recognizes respect, connectedness, choice, personal relevance, challenges, engagement, authenticity, and effectiveness. Practice teachers need relevant exposure and immersion to fully develop their competence in CRT. This scenario (...) necessitates attention to assessing the competence of 191 practice teachers in CRT, correlating their competence across dimensions, and verifying the role of gender and degree programs in competence development. This investigation provides evidence on the role of gender in competence development toward culturally responsive teaching. Such competence is vital in practice teachers, especially because they are exposed to learners with diverse backgrounds during their teaching internship. This paper finds out whether a higher degree matters in school performance, and in demonstrating leadership and core behavioral competencies among school heads. This was conducted to support the existing and future policies of the Department of Education and interested funders for the scholarship and advanced studies of school heads. Using a cross-sectional method, it involved 192 randomly selected participants. Data on school performance was obtained at the office of Surigao del Sur Division, while data on competencies were gathered through (...) the self-administered assessment tools developed by the Department of Education. These data were analyzed using descriptive statistics and analysis of variance. Results revealed that there was no significant difference in the school performance of school heads. This implies that the highest degree obtained is not a guarantee for better school performance. As found, those with doctorate degrees had a very high and consistent demonstration in all dimensions of leadership and core behavioral competencies. As unveiled, there were significant differences in the demonstrated competencies based on the highest educational qualifications. These imply that obtaining the highest degrees can allow school heads to acquire, develop, and demonstrate the competencies consistently better than their counterparts. Results have implications for DepEd officials, funders, and policy-makers. (shrink)

In a pessimistic view, the world is a series of struggles and sufferings. The tribulations are inevitable to man’s life for he is in the world. Pandemic, poverty and corruption are the most prominent and prevailing faces of struggles in the world. It affects the individual’s lives deeply for it undercuts the experience of being alive and free. It weakens man’s appreciation of moments due to misery. The conflicts in the world holds man to appreciate moments for they are occupied (...) on their functionality. The world simply becomes a mechanical for the people lives like a machine where working is much important than reflecting. These problematic figures were paralleled to Gabriel Marcel’s concept of broken world. The paper tends to justify that the world is broken for the reason that first, its problems that could be seen in the contemporary world as pandemic, poverty and corruption. Second, man becomes alienated from himself for he ceases on living due to this problematic world. This paper also ventured to Gabriel Marcel’s concept of broken world which eventually paralleled to the mainstream problems in contemporary world. In practical reasoning, reasonableness ‐ as opposed to rationality ‐ is an important concept. This paper explores the notion of reasonableness as applied exclusively to legal decisions. Conflicting values or legal requirements can make rationally deduced solutions unattainable, and may call for criteria of reasonableness, Conflicting values must be weighed, and weighed against each other, in search of a point of equilibrium between them. Legal cases are more or less difficult to solve, depending on the difficulty of finding a unique (...) optimal equilibrium. The relevance of factual and ideal consensus for the determination of a reasonable legal decision is underlined. Finally, a definition of “reasonable legal decision” is proposed. (shrink)

El formalismo no es la única dolencia que aqueja al Derecho o, mejor, a quienes tienen la función de interpretarlo y aplicarlo. Pero es quizás la más perniciosa en los países latinos por el carácter de enfermedad endémica que ha adquirido en nuestra cultura jurídica. Es cierto, por otro lado, que no todo lo que se llama a veces "formalismo" es igualmente rechazable; e incluso hay un formalismo -un significado de esa expresión- que no lo es en absoluto. El Derecho (...) es, en buena medida, un fenómeno de autoridad; en el mismo, las razones formales tienen una importancia fundamental, lo que no ocurre, por ejemplo, en la moral. Por eso, los jueces no deben dialogar, como a veces se dice, de tú a tú con la Constitución y con las leyes, sino que deben reconocer la autoridad de la una y de las otras; en el caso del juez constitucional, el sometimiento a la Constitución debe ir unido a la deferencia hacia el legislador como principio interpretativo fundamental. Si las cosas no fueran así, no habría Estado de Derecho, simplemente porque el imperio de la ley habría pasado a ser imperio o gobierno de los jueces. (shrink)

The author's starting point is Bobbio's theoretical approach to the problems of the relations between law and reason. He then appraises the meanings of reason and the concept of theoretical and practical rationality in the application of law. He examines the complex problem of the rationality of legislation and distinguishes five levels of rationality.

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. The philosophical implication that guides the issue addressed here is the following: how does the principle of the common constitute a frontal apophasis to the principle of property in contemporary democracies? I do not pretend to offer an exhaustive answer to this problem. However, I use the argumentative strategy of dividing this paper into three sections: (i) theoretically investigate the dialectical tension between the principle of the common and the principle of property; (ii) analytically observe the premise that the behavioral (...) practices of exacerbated individualism contribute as an act of aversion to the principle of the common and (iii) dwell on the articulation of the notion of the principle of the common as a factor that is present on the threshold between the philosophical vulgar and philosophical universal. Finally, I form some considerations that problematize the naturalized notion of the principle of property in current democracies, in view of the constituent power that the principle of the common holds in the perspective of achieving the well-being of human agents in contemporary community life. Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

Theoretical tools aimed at making explicit the injustices suffered by certain socially disadvantaged groups might end up serving purposes which were not foreseen when the tools were first introduced. Nothing is inherently wrong with a shift in the scope of a theoretical tool: the popularization of a concept opens up the possibility of its use for several strategic purposes. The thesis that we defend in this paper is that some public figures cultivate a public persona for whom the conditions of (...) the notion of testimonial injustice might be taken to apply, and this situation is exploited to their advantage, as a means to advance their political agendas. The artificial intelligence models with machine learning that exhibit the best predictive accuracy, and therefore, the most powerful ones, are, paradoxically, those with the most opaque black-box architectures. At the same time, the unstoppable computerization of advanced industrial societies demands the use of these machines in a growing number of domains. The conjunction of both phenomena gives rise to a control problem on AI that in this paper we analyze by dividing the issue into two. First, we carry out an (...) epistemological examination of the AI’s opacity in light of the latest techniques to remedy it. I deal here with one of Boghossian’s arguments against content externalism, related to ourinferential rationality(to use his term). According to his reasoning, the apriority of our logical abilities is inconsistent with certain externalist assumptions. Nevertheless, the problem constitutes an important challenge foranytheory of content, not just for externalism. Furthermore, when we examine what internalists may propose to solve the problem, we see that externalists have at their disposal a more promising repertoire of possible replies than internalists. In that sense, insofar (...) as Boghossian’s scenario is relevant to the debate externalism/internalism, it can be seen (against Boghossian’s original intention) as providing additional evidence for content externalism. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

According to the partisan cheerleading view, numerous political disagreements that appear to be genuine are not authentic disputes, because partisans _deliberately_ misreport their beliefs to show support for their parties. Recently, three arguments have been put forth to support this view. First, contemporary democracies are characterized by affective rather than ideological polarization. Second, financial incentives indicate that partisans often deliberately misreport their beliefs to express their attitudes. Third, partisans have inconsistent and unstable political beliefs, so we should not take these (...) attitudes seriously. In this paper, I examine these arguments and present an alternative view, which I call the partisan conviction view. According to it, partisans are not necessarily insincere in their political judgments, and they are in genuine disagreement. (shrink)

Plural definite descriptions across many languages display two well-known properties. First, they can give rise to so-called non-maximal readings, in the sense that they ‘allow for exceptions’. Second, while they tend to have a quasi-universal quantificational force in affirmative sentences, they tend to be interpreted existentially in the scope of negation. Building on previous works, we offer a theory in which sentences containing plural definite expressions trigger a family of possible interpretations, and where general principles of language use account for (...) their interpretation in various contexts and syntactic environments. Our theory solves a number of problems that these previous works encounter, and has broader empirical coverage in that it offers a precise analysis for sentences that display complex interactions between plural definites, quantifiers and bound variables, as well as for cases involving non-distributive predicates. The resulting proposal is briefly compared with an alternative proposal by Križ, which has similar coverage but is based on a very different architecture and sometimes makes subtly different predictions. This book is conceived as an introductory text into the theory of syntactic and semantic information, and information flow.

Although the sunk‐cost effect is a well‐documented psychological phenomenon in monetary investments, existing literature investigating behavioral investments (e.g., time, effort) has not replicated this effect except when such investments relate to monetary values. The current explanation for this discrepancy proposes that purely behavioral sunk‐cost effects are unlikely to be observed because they are difficult to book, track, and balance in a mental account. Conversely, we argue that, through an effort‐justification mechanism, people account for the amount of behavioral resources invested when (...) selecting an alternative, in which case they may fall prey to purely behavioral sunk‐cost effects. The results of two experiments support this prediction. Because many decisions involve behavioral investments, behavioral sunk‐cost effects should be pervasive psychological phenomena. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

Recent years have seen recurring episodes of tension between proponents of freedom of speech and advocates of the disenfranchised. Recent survey research attests to the ideological division in attitudes toward free speech, whereby conservatives report greater support for free speech than progressives do. Intrigued by the question of whether “canceling” is indeed a uniquely progressive tendency, we conducted a vignette-based experiment examining judgments of offensiveness among progressives and conservatives. Contrary to the dominant portrayal of progressives and conservatives, our study documented (...) ideological symmetry in their evaluations of offensive speech. When faced with utterances whose content matters to them, both conservatives and progressives viewed outgroup speakers as more offensive than ingroup speakers. A second contribution of this chapter is to provide a deeper understanding of the cognitive mechanism implicated in evaluating outgroup speech as more offensive than ingroup speech. Our results suggest that perception of offensiveness is mediated by ascriptions of intent: we tend to attribute negative intent to the speaker whenever we deem their utterances to be offensive, even against the explicitly stated speaker’s background attitudes. Asperger's syndrome is a pervasive developmental condition characterized by features of autism. As observed in clinical practice, individuals with Asperger's syndrome present an impairment related to inflexibility in their everyday routine, an immediate manner of experiencing and relating, and difficulties in estimating periods of time. Following a phenomenological perspective, this study is an attempt to examine these aforementioned aspects in terms of temporality. Thirteen participants with Asperger's syndrome, from 13 to 20 years old, were interviewed about their experience of periods (...) of time, personal history, their past, present and future; and their concept of time and finitude. After the interviews, it was possible to identify three general themes which emerged in the invariant aspects of their experience of time: factual experience of present and future dimensions, chronological time and the past experience. Moreover, participants' descriptions evidenced aspects of experience based on the specificity of lived facts and a sense of time specifically related to what was lived in the past. (shrink)

The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

French naturalists at the Muséum Nationale d’Histoire Naturelle in Paris in the early nineteenth century recognized that their individual and collective successes were intimately linked to questions of power over specimens. France’s strength abroad affected the growth of the museum’s collections. At the museum, preserving, naming, classifying, displaying, interpreting, and otherwise deploying specimens went hand in hand with promoting scientific theories, advancing scientific careers, and instructing the public. The control of specimens, both literally and figuratively, was the museum’s ongoing concern. (...) The leopard in this essay’s title, a live specimen confiscated from the streets of Paris in 1793, serves here to represent the tensions created in an existing order of things by the introduction of a potentially disruptive agent. The essay explores the life of the museum and the interrelations among its naturalists, the special challenges created by the establishment of a menagerie, and the histories of particular specimens and ideas. The central aim of the present investigation is to shed light on Nietzsche’s understanding of happiness and a good life, starting from Nietzsche’s appropriation of Plato’s and Aristotle’s doctrine of a hierarchy of human beings and forms of life.

When public opinion gets polarized, the population’s beliefs can experience two different changes: they can become more extreme in their contents or they can be held with greater confidence. These two possibilities point to two different understandings of the rupture that characterizes political polarization: extremism and radicalism. In this article, I show that from the close examination of the best available evidence regarding how we get polarized, it follows that the pernicious type of political polarization has more to do with (...) radicalism than with extremism. Reinforcing the confidence in the core beliefs of the group we identify with makes our beliefs immune to the reasons coming from the other political side. Finally, I also suggest that the rise of political polarization is not necessarily the result of an irrational process. (shrink)
